By accepting these terms and conditions, Customer agrees that the Customer is 18 years or above and is thus a major under Indian Laws and thus legally capable to enter in to contract and in case Customer is acting on behalf of some business entity, Customer is duly authorized to enter in to agreement on behalf of the entity Customer is representing.
PLEASE READ THEM CAREFULLY BEFORE YOU PROCEED WITH YOUR ORDER. DO NOT PROCEED WITH YOUR ORDER IF YOU DO NOT ACCEPT THE TERMS AND CONDITIONS.
Now therefore, by ordering and/or using Home-in-Hand's items and/or services, Customer agrees to be bound by all of the terms and conditions of this agreement (hereinafter referred to as the agreement)
This agreement is entered between Home-in-Hand and the payer or/and the recipient of products/services hereunder as identified as part of the subscription process for Home-in-Hand Services herein after called as "Customer",
Now Whereas Customer and Home-in-Hand both hereby agree to the terms & conditions hereinafter mentioned:
Home-in-Hand offers Home automation devices (The Item) and services to control the same through internet/mobile applications (The Service) which includes the following:
Customer shall pay immediately to Home-in-Hand the amount stated in the order. This obligation shall be due and demand-able without the need of a legal demand.
If a payment is not received when it is due or payment method is declined, the customer forfeits the ownership of any items purchased. If no payment is received, no items will be shipped.
Similarly, Home-in-Hand reserves the right to suspend service in case payment is not received when it is due. Resumption of service would be done after mutual agreement and on receipt of payments along with interest, if any.
Shipping will be paid for by the customer in the amount agreed upon by Home-in-Hand at the time of purchase. If an item is lost during shipping, the total cost of item, including shipping, will be refunded to the Customer by Home-in-Hand. However, refund on the lost shipping shall not be applicable if the Customer opts for normal mail delivery.
Home-in-Hand provides refund/returns of your purchase in the following cases:
Such issues should be reported to us within 7 days from the date of the purchase. Clear evidence must be provided proving that the purchased item is not as it described on the website. Complaints which are based merely on the customer's false expectations or wishes will not be honored.
No refund would be entertained for payment made against services to be provided.
An item may be cancelled up until payment has been processed. Once payment has been processed, the order can not be cancelled.
Home-in-Hand uses services of Third-parties like Google, PayU money, Amazon Web Services etc. Home-in-Hand reserves the right to enter and exit an agreement to use services of any third-party in order to deliver its items and services to the customer at any time without notice to the customer.
Home-in-Hand seeks the following information from the Customer in order to provide its services:
Name, Email, Address (Optional), Phone Number (Optional)
Home-in-Hand does not use any of the above information for any other purpose beyond providing the item and service to the Customer. Home-in-Hand will make reasonable efforts to secure the information on its site, so that the data is not vulnerable to hacking, phishing etc. Home-in-Hand is not responsible for any data shared by the Customer with the third-parties whose services is used by Home-in-Hand.
Customer hereby agrees to use the item and services of Home-in-Hand only in authorized manner as per terms agreed upon and law of the land. In case it is found that use of services violates the terms of this agreement or any other law, rule or regulation enacted by the concerned authorities from time to time, Home-in-Hand reserves the right to terminate the agreement with immediate effect, without assigning any reason, whatsoever.
In the performance of Services, Home-in-Hand agrees to:
Perform the Services to the best of its ability and with the degree of care, diligence and skill that a reasonably prudent person would exercise in comparable circumstances;
Liaise with Customer through Customer's coordinator on matters related to the Services;
Notify Customer, whenever practicable, if expenses beyond the agreed charges may be incurred;
Invoice Customer according to the terms of this Agreement and the applicable Service Schedule for the Services performed; and
Proceed according to Customer's reasonable instructions for the disposition of Customer's Data and supplies on the termination of any Service Schedule.
Inform customer whenever possible about an outage to the service due to maintenance.
Home-in-Hand warrants that it will at its expense make commercially reasonable attempts to correct any errors for which Home-in-Hand is directly and solely responsible by rerunning the Service, provided that the Data necessary to correct such errors is available to Home-in-Hand; or at Home-in-Hand's option provide a credit to Customer equivalent to the charge that would have been applicable for correcting that portion of the Service that is in error, such credit will be only for errors due solely to malfunction of a item, system or Software provided by Home-in-Hand or any error made by Home-in-Hand's personnel in the performance of the Service within the warranty/service period. To obtain the rerun Service or the credit, Customer must notify Home-in-Hand in writing of such errors within seven days of receipt of the Services believed to contain the errors. Home-in-Hand is not liable to provide corrective measures on item out of warranty/maintenance contract.
Customer agrees to:
Provide all necessary Data and any special forms or other required materials or information to Home-in-Hand on schedule or in a timely fashion to enable Home-in-Hand to provide the Services;
Ensure the accuracy, legibility, and completeness of all Data supplied to Home-in-Hand and be solely responsible for the results obtained from Customer's use of any of the Services;
Liaise with Home-in-Hand through a coordinator Customer will identify, on matters related to the Services and authorize that coordinator to make decisions on behalf of Customer in relation to the implementation of this Agreement and the Services and any changes thereto;
Comply with Home-in-Hand's security and operating procedures (as may be revised or amended by Home-in-Hand from time to time) when Customer's employees or agents are interfacing with Home-in-Hand installed items;
Control, and be responsible for the use of, account information, user ids and passwords related to the Services and, where required, when interfacing with Home-in-Hand installed systems;
Understand that Customer's sole remedy for any claims regarding the Services is limited to the credits set forth and agreed as per tariff plan opted by the Customer;
Understand that Customer is fully responsible for the content of the information and data passing through Home-in-Hand's network or using the Services and for all activities that Customer conduct with the assistance of the Services;
Customer represents and warrants to Home-in-Hand that: (a) the information Customer has provided for the purpose of establishing an account with Home-in-Hand is accurate, and (b) Customer has complied with and will continue to comply with all applicable privacy laws and has obtained and will continue to obtain the requisite privacy consents in the collection and use of all information that may be collected on any website or maintained on any server hosted by Home-in-Hand.
Home-in-Hand may update, amend, modify or supplement the terms and conditions of this Agreement from time to time. While every reasonable effort will be made to notify Customer regarding the same, Customer is responsible for regularly reviewing the most current version of this Agreement at any time at https://www.home-in-hand.com/terms. If at any time Customer do not agree with any amendment, modification or supplement to the terms and conditions of this Agreement, Customer may terminate this Agreement with mutual understanding with Home-in-Hand. Customer's continued use of Customer's account and/or the services after the notice period will be conclusively deemed to be acceptance by Customer of any such modifications or amendment.
Customer agrees, in the event any claim or suit is brought in connection with this Agreement, it shall be brought to the exclusive jurisdiction and venue of the courts of Delhi, India. In any action to enforce this Agreement, including, without limitation, any action by Home-in-Hand for the recovery of fees due hereunder, Customer shall pay reasonable attorneys' fees and costs in connection with such action.
The terms and conditions along with privacy policies with all references, constitutes the sole and entire agreement of the parties to this agreement with respect to the subject matter contained herein, and supersedes all prior terms and conditions which were agreed by the Customer.
